Contested divorce with child custody: example of a successfully resolved case
A tense situation, with children at the heart of the conflict
Divorce is never easy. But when it is contested, involves young children, and no common ground seems possible, the stakes become human, legal, and emotional. It was in this type of situation that a law firm was recently called upon.
The client was going through a difficult separation. She had two young children, an ex-spouse who was opposed to any form of compromise, a total lack of communication, and above all, a categorical refusal to pay child support, even though it was considered reasonable. Added to this was a fundamental disagreement over custody arrangements: the mother wanted shared custody, but the father demanded sole custody, without any concrete justification.

Preparation of the legal case: drafting of a complete petition including a request for shared custody and child support in accordance with the scales set out in the Act.
Representation before the Superior Court, including management of preliminary hearings and the client’s testimony.
The result: a balanced ruling
After several months of proceedings, the court recognized the stability provided by the mother, the genuine involvement of both parents, and the best interests of the children. The ruling granted shared custody with equitable alternation and awarded child support in line with the father’s income.
The client was able to move on, reassured by the soundness of the ruling and, above all, by the recognition of her parental commitment.
