During the initial consultations my clients often ask me if I have some experience with estate battle. I answer usually that I only deal with inheritance disputes, unfortunately. Usually if the clients end up with seeing me, it is because the liquidation of the Estate does not go as it was supposed to.
Succession law:
Knowing how to listen and understand:
Succession law is a legal domain requiring certain experience. Listening is one of the principal skills a lawyer should have in order to understand a complicated succession case. Before acting, it is primordial to find out why and how the situation developed the way it did. Is this because of vague wording of the last will? Was the will obtained by some fraudulent maneuvers? Is it because the liquidator is not doing his (her) job properly? Is there a conflict among the heirs? Or maybe there is a conflict between the heirs and the liquidator?
Mediation is a possibility:
Once the situation is understood, it is important to choose a strategy. Sometimes mediation is the best solution. Many times in our practice we succeeded to find a solution acceptable for all the parties in a succession. There is also a saying that a settlement is better than any good judgment.
Launching an attack:
Unfortunately, most of the cases regarding successions end up in court. Rights are vague and uncertain, so only the court could find a proper remedy. Legal process is often long and unpleasant for the parties in the law of successions. Also, it is rather expensive to bring a case to the courts.
