They say justice system was brought up by human civilization to replace fistfights and vengeance.
If this is true, no surprise that people are looking for an “aggressive” lawyer, a “gladiator” lawyer to fight for them or — better said — in their stead. No surprise that justice system is seen as an arena for exactly that — a fight.
Convinced by certain American TV series, people look for a lawyer ready to do “whatever it takes”, to gnaw, to grab, to claw hold — all for the sake of a victory.
Aggressive lawyer in practical reality
Does it not sound appealing? Aggressive lawyer with a scary look, bloody cold eyes, sneaky manners and no moral principles? Well, it does not, at least not always. And not (only) for obvious moral reasons, but more so for practical reasons.
First, judges usually do not like this sort of a lawyer. Which means, an aggressive lawyer can damage your case simply by his(her) attitude.
Second, such lawyers have a tendency to promise way too much, instilling a comforting but dangerous feeling of false confidence into clients. This leads to risky moves which would be never taken if a client were properly informed. Remember that usually it is a client, not his lawyer, who is punished by the Court for those risky moves.
Third, an aggressive and overconfident lawyer might actually try something sneaky. This, when revealed before a judge, might ruin even an otherwise solid and strong case.
So, do you actually need an aggressive lawyer? Maybe. But even more you need an honest and diligent one. Because at the end of the day it will be you who is to bear the consequences.
