As the seller, you are responsible for hidden defects, even if you were unaware of them at the time of sale. However, you are not liable for apparent defects, those that you have notified to the buyer, or those that the buyer knew about or could have seen at the time of the transaction.

As a buyer, you don't have to hire a home inspector before making a purchase. However, defects that a vigilant and attentive buyer might have detected are not guaranteed by law.
